YOUR AGREEMENT WITH THE CRUISE BOYS® – powered by KVI Travel

The Cruise Boys® is the trade/marketing name of an independent travel advisor affiliated with, and hosted by, KVI Travel (Vancouver, British Columbia, Canada), which acts as the agency of record and registered seller of travel for bookings arranged through The Cruise Boys®.
Before we make arrangements for your flight, hotel, car rental, tour, cruise, or other travel services, we require that you review and acknowledge your agreement with the following Terms and Conditions.
By making payment to KVI Travel or The Cruise Boys® – powered by KVI Travel (collectively, “The Cruise Boys®,” “KVI Travel,” “we,” “us,” or “our”), accepting travel arrangements, or otherwise authorizing us to arrange travel on your behalf, you acknowledge that you have reviewed and accepted these Terms and Conditions. If you are making travel arrangements for other travelers, you represent that you are authorized to act on their behalf and that these Terms and Conditions apply to all travelers on the booking, including family members, companions, or any other person for whom you make payment or travel arrangements.
The Cruise Boys® offers retail and interline travel services to customers and acts solely as an agent for separate and independent travel suppliers, including but not limited to airlines, hotels, car rental companies, cruise lines, tour operators, ground transportation providers, shore excursion providers, attractions, and other travel service providers (collectively, “Suppliers”). The Cruise Boys® does not own, operate, manage, or control the services or products provided by any Supplier.
Relationship of the Parties
The Cruise Boys® is an independent travel advisor operating under and hosted by KVI Travel, which is the agency of record and the registered seller of travel for your booking. Except where these Terms expressly refer only to The Cruise Boys®, references to “we,” “us,” and “our” include KVI Travel. Travel payments are collected and processed in the name of KVI Travel (or the applicable Supplier). Nothing in these Terms creates a joint venture, partnership, employment, or agency relationship between you and The Cruise Boys® or KVI Travel other than the limited booking agency described in the “Authorization to Act on Your Behalf” section below.
Liability and Supplier Deviations
THE FOLLOWING LIMITATIONS ARE A MATERIAL PART OF THIS AGREEMENT. PLEASE READ THEM CAREFULLY. While The Cruise Boys® strives to work with reputable Suppliers, we assume no responsibility for and shall not be liable for any refund, personal injury, property damage, loss, accident, delay, inconvenience, irregularity, or expense arising out of or related to:
• any default, wrongful act, omission, negligence, or failure to perform by any Supplier;
• any defect in or failure of any vehicle, vessel, aircraft, equipment, or other instrumentality owned, operated, or otherwise used by any Supplier; or
• any act or omission of any other party not under the control of The Cruise Boys®.
Suppliers reserve the right to deviate from any direct, customary, or scheduled route, itinerary, port of call, aircraft, vessel, accommodation, amenity, schedule, or other aspect of travel for any reason, at any time, and with or without notice. Traveler(s) acknowledge and agree that The Cruise Boys® is not responsible for Supplier deviations, delays, cancellations, overbookings, mandated overnight stays, missed connections, schedule changes, or any other condition beyond our control.
Limitation of Our Liability
To the fullest extent permitted by applicable law, and notwithstanding anything to the contrary in these Terms, the total aggregate liability of The Cruise Boys® and KVI Travel to you for any and all claims arising out of or relating to your booking, these Terms, or the services we provide as a travel agent shall not exceed the total amount of service fees and/or commissions we actually earned and retained on the affected booking. In no event shall The Cruise Boys® or KVI Travel be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost enjoyment, or emotional distress, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be excluded or limited under applicable law, including liability for fraud, willful misconduct, or personal injury or death caused by our own negligence to the extent such limitation is prohibited by law.
Force Majeure
“Force Majeure” means any circumstance beyond the reasonable control of The Cruise Boys®, including but not limited to acts of God, flood, fire, explosion, severe weather, natural disasters, war, threat of war, terrorism, sabotage, riots, civil unrest, strikes, labor disruptions, government action, border closures, quarantine, epidemic, pandemic, public health events, mechanical failures, transportation interruptions, wildlife, or other unforeseen occurrences.
The Cruise Boys® shall not be liable for any loss, damage, delay, cancellation, or failure to perform resulting from any Force Majeure event or from any Supplier being unable to perform its obligations due to circumstances beyond its control.
Supplier Contracts and Pricing
Traveler(s) acknowledge and understand that Suppliers, including airlines, cruise lines, hotels, tour operators, and other travel providers, maintain their own terms and conditions, including but not limited to deposit requirements, cancellation penalties, refund limitations, check-in requirements, baggage policies, documentation requirements, and restrictions on changes. Your travel arrangements are subject to the terms and conditions of the applicable Supplier, and those terms may be provided through booking materials, confirmations, Supplier websites, or upon request.
Pricing and availability are subject to change until a booking is confirmed and payment is received. Traveler(s) agree that The Cruise Boys® is not responsible for any errors or omissions in quotes, advertisements, website content, or pricing resulting from inventory discrepancies, Supplier changes, third-party information, or electronic, clerical, or printing errors. Suppliers reserve the right not to honor any published prices that they determine were erroneous. You acknowledge this right and agree to hold The Cruise Boys® harmless for any actions, adjustments, or damages resulting from Supplier pricing errors.
Once payment has been made and a booking is confirmed, additional charges may still apply if imposed by a Supplier or governmental authority due to matters beyond the control of The Cruise Boys®, including but not limited to increases in taxes, port charges, fuel surcharges, carrier-imposed fees, government assessments, or currency fluctuations.
Our Service Fees
The Cruise Boys® may charge professional service fees (for example, planning, consultation, booking, change, or cancellation fees) separate from amounts charged by Suppliers. Any such fees will be disclosed to you before they are charged. Unless expressly stated otherwise in writing at the time of booking, service fees charged by The Cruise Boys® are earned when charged and are non-refundable, even if a Supplier later cancels, changes, or refunds the underlying travel arrangements. Supplier deposits, payments, and penalties are governed by the applicable Supplier’s terms.
Interline Eligibility and Verification
Certain fares, rates, amenities, or promotions offered through The Cruise Boys® may be designated as interline, industry, employee, resident, military, first responder, or other restricted-rate programs. All such offers are strictly subject to eligibility verification by the applicable Supplier and may be changed, withdrawn, repriced, canceled, or denied if eligibility is not established or is later determined not to apply.
Traveler(s) are solely responsible for providing complete, accurate, and timely eligibility documentation as required by the applicable Supplier. The Cruise Boys® is not responsible for the withdrawal of any restricted-rate offer, repricing, cancellation, denial of boarding, loss of benefits, or any other consequence resulting from a traveler’s failure to qualify for or properly document eligibility under a Supplier’s program.
Booking Accuracy / Legal Names
Traveler(s) are required to immediately review all aspects of their booking and verify all details, including but not limited to traveler names, mailing address, date of birth, pricing, airfare, arrival and departure airports, accommodations, cabin or room category, and organized activities. Please notify The Cruise Boys® immediately if any corrections or omissions are identified. Traveler(s) voluntarily assume full responsibility for any and all risks, penalties, losses, or costs associated with failing to promptly report errors or omissions.
The name, date of birth, and gender listed on your reservation and airline ticket must exactly match the information on your passport or government-issued identification. The Cruise Boys® strongly recommends that you confirm passport validity well in advance of travel, as many countries require passports to remain valid for at least six (6) months beyond the return date of travel. Non-United States citizens may require additional documentation. Children and infants also require proper travel documents.
Travel Documentation, Entry Requirements, and Visa Refusal
Traveler(s) are solely responsible for obtaining and carrying all required travel documents, including but not limited to valid passports, visas, vaccination records, testing documentation, parental consent forms, re-entry permits, and any other documentation required by the destination, transit points, carriers, or Suppliers.
The Cruise Boys® is not responsible for denied boarding, denied entry, missed travel arrangements, cancellation losses, additional expenses, delays, or any other damages resulting from incomplete, expired, inaccurate, or missing travel documents; failure to satisfy entry requirements; failure to obtain a visa; visa refusal; passport issues; name discrepancies; or any decision made by an airline, cruise line, immigration authority, border official, consulate, embassy, or government authority.
Travelers with Disabilities and Special Requirements
Accessibility features, medical facilities, and accommodation of disabilities or special needs are controlled by the Suppliers, not by The Cruise Boys®. Traveler(s) are responsible for advising The Cruise Boys® at the time of booking of any disability, medical condition, mobility limitation, dietary restriction, or other special requirement, and for confirming directly with the applicable Supplier that their needs can be met. The Cruise Boys® does not warrant the suitability of any trip, vessel, property, conveyance, or destination for any person with disabilities or special needs and is not responsible for a Supplier’s inability or failure to provide such accommodations.
Travel Risks and Release of Liability
The Cruise Boys® has no special knowledge regarding the financial condition of Suppliers, unsafe conditions, health hazards, weather hazards, climate extremes, political conditions, civil unrest, or the suitability for disabled persons of any portion of any trip. For information concerning possible dangers at destinations, we recommend reviewing current guidance from the U.S. Department of State and other applicable authorities. For medical and health-related travel information, we recommend consulting the Centers for Disease Control and Prevention and any appropriate medical professionals.
You assume full responsibility for checking and verifying all conditions relating to health, safety, security, entry requirements, travel documentation, political stability, and labor or civil unrest at any destination. You hereby release The Cruise Boys® from claims arising out of matters addressed in this paragraph to the fullest extent permitted by law.
Authorization to Act on Your Behalf
By requesting that The Cruise Boys® arrange travel on your behalf, you authorize The Cruise Boys® to act as your booking agent for the limited purpose of arranging, confirming, and processing travel services with Suppliers, including submitting traveler information, accepting Supplier terms as necessary to complete bookings, and processing payment authorizations based on your instructions or the instructions of a person reasonably believed to be acting on your behalf.
You agree to pay for all charges authorized in connection with your travel arrangements and agree not to hold The Cruise Boys® responsible for actions taken in good faith reliance on your communications or the communications of a person reasonably believed to be acting on your behalf. If you make arrangements for other travelers, you represent and warrant that you are authorized to do so, and you agree to indemnify The Cruise Boys® and KVI Travel against any claim by any such traveler arising from your lack of authority.
Indemnification
You agree to indemnify, defend, and hold harmless The Cruise Boys® and KVI Travel, and their owners, employees, and affiliates, from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms, your violation of any law or Supplier term, the inaccuracy of information you provide, or your acts or omissions (or those of any traveler on your booking) before, during, or after travel.

The content and images contained on this website, including downloadable files, are protected by copyright and other applicable intellectual property laws. You agree not to use, reproduce, distribute, or authorize the use of this information for any purpose other than personal, non-commercial use, and you agree not to engage in the resale, redistribution, or commercial exploitation of any content from this website without prior written permission.

Privacy Policy
By agreeing to these Terms and Conditions, you also consent to our Privacy Policy, available at https://www.thecruiseboys.com/privacy-policy, which details how we collect, use, and share your personal information with Suppliers to facilitate your travel arrangements. Because KVI Travel is located in Canada and Suppliers may be located in other countries, you acknowledge that your personal information may be transferred to, stored in, and processed in the United States, Canada, and other jurisdictions with different data-protection laws. Our collection and use of personal information is governed by applicable privacy laws, which may include the California Consumer Privacy Act, the Florida Digital Bill of Rights, and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).
Chargebacks and Payment Disputes
Traveler(s) agree to contact The Cruise Boys® in writing as soon as possible regarding any concern, billing question, or dispute related to any booking, charge, fee, or service arranged by The Cruise Boys® so that we may have a reasonable opportunity to review and attempt to resolve the matter before a chargeback or payment dispute is initiated with a credit card issuer, bank, or other financial institution.
Traveler(s) acknowledge that many travel arrangements are subject to Supplier terms and conditions, including non-refundable deposits, cancellation penalties, and other restrictions, and that initiating a chargeback does not cancel a booking or eliminate any amounts otherwise validly owed under the applicable Supplier’s terms. Traveler(s) agree to remain responsible for any amounts properly due and owing for authorized travel services, including any non-refundable charges, cancellation penalties, or other fees imposed by a Supplier or disclosed by The Cruise Boys®. Nothing in this section limits or waives any rights you may have under applicable law, including the Fair Credit Billing Act or the dispute procedures of your card issuer.
Consent to Receive Booking Communications
By requesting travel services from The Cruise Boys®, Traveler(s) consent to receive communications from The Cruise Boys® related to quotes, bookings, payments, itinerary updates, travel reminders, schedule changes, Supplier notifications, service issues, and other operational matters related to travel arrangements. Such communications may be sent by email, telephone, or text message/SMS using the contact information provided by you or on your behalf.
Traveler(s) are responsible for providing accurate contact information and for updating The Cruise Boys® promptly if contact details change. Consent to receive operational and booking-related communications is not a condition of purchasing any travel services, and is separate from any consent to receive marketing communications, and may include messages that are necessary to administer or service a booking. Message frequency varies. Message and data rates may apply. You may opt out of text messages at any time by replying STOP, and reply HELP for help. We will not condition the purchase of any travel services on your consent to receive marketing texts.
Dispute Resolution, Binding Arbitration, and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A CLAIM IN COURT. Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively through final and binding arbitration rather than in a court of law, except that either party may bring an individual claim in a small-claims court of competent jurisdiction. The arbitration shall be conducted in Orange County, Florida, USA, before a single neutral arbitrator administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award may be entered in any court of competent jurisdiction. If you are a consumer, the arbitration may take place in the county of your residence or by videoconference at your election, and the allocation of arbitration fees shall be governed by the AAA’s Consumer Arbitration Rules.
Furthermore, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to participate in a class-action lawsuit or class-wide arbitration. If for any reason a claim proceeds in court rather than in arbitration, both you and The Cruise Boys® waive any right to a trial by jury. If the class-action waiver in this section is found to be unenforceable as to any claim, then that particular claim shall be severed and adjudicated in court, and all remaining claims shall continue to be resolved in arbitration.
Governing Law
These Terms and Conditions, and any dispute arising out of or relating to them, shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict-of-laws principles, and, where applicable to arbitration, the Federal Arbitration Act. This choice of law does not deprive you of the protection of any mandatory consumer-protection laws of your place of residence that cannot be waived by agreement.
Modification of Terms
The Cruise Boys® reserves the right to modify these Terms and Conditions at any time without prior notice. The version of the Terms and Conditions in effect at the time your initial payment is made will govern your booking. Any modified Terms will apply to bookings for which initial payment is made after the modified Terms are posted, and your continued use of our services after such posting constitutes acceptance of the modified Terms as to those future bookings.
Seller of Travel Registration and Disclosures
Bookings arranged through The Cruise Boys® are made through KVI Travel as the agency of record and seller of travel. Registration as a seller of travel does not constitute approval by any state. To the extent required by law, The Cruise Boys® operates as an independent agent under the seller-of-travel registration of KVI Travel.
Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
Entire Agreement; No Waiver; Assignment
These Terms and Conditions, together with our Privacy Policy and any booking confirmation or invoice, constitute the entire agreement between you and The Cruise Boys® regarding the subject matter herein and supersede any prior oral or written understandings. No failure or delay in exercising any right shall operate as a waiver of that right. You may not assign your rights or obligations under these Terms without our prior written consent; we may assign these Terms to an affiliate or successor. Section headings are for convenience only and do not affect interpretation.
Electronic or Handwritten Signature
Both parties agree that you may acknowledge and accept these Terms and Conditions: (a) electronically; (b) by handwritten signature; (c) by email confirmation or other electronic communication; or (d) by your conduct, including payment of any invoice or use of any travel services arranged by The Cruise Boys®. Any such acceptance shall be deemed effective and binding to the fullest extent permitted by law.
Travel Insurance Protection
Travel insurance is strongly recommended. As your travel advisor, The Cruise Boys® recommends the purchase of travel insurance to help protect against risks inherent in travel, including but not limited to Supplier default or bankruptcy, travel delay, interruption, cancellation, medical emergency transportation, evacuation, repatriation, baggage loss, baggage delay, illness, accidental death, disability, and travel accident or sickness medical expenses.
By declining travel insurance, Traveler(s) acknowledge and accept responsibility for any cancellation penalties, non-refundable payments, damages, losses, and out-of-pocket expenses that may be incurred in connection with the trip.
If purchasing travel insurance, we urge you to thoroughly review the policy documents and confirmation of benefits, including coverage limits, exclusions, and claim procedures. Please note that the insurance provider may be restricted by privacy laws from discussing your claim with The Cruise Boys®. Traveler(s) acknowledge and agree that The Cruise Boys® has no control over the insurance provider, policy administration, claim handling, or coverage decisions, and is therefore not responsible for coverage determinations, claim outcomes, delays, or denials. Any travel insurance is provided by a third-party insurer; The Cruise Boys® is not the insurer, does not provide insurance advice, and, where it transmits insurance offers, does so only as permitted by applicable licensing law.
